A depraved sex offender who broke into a 90-year-old woman’s home and attempted to rape her committed the crime out of sexual frustration, a court has heard.

Shane Huici, 26, will remain behind bars after he appeared in Melbourne County Court on Thursday, where Judge Pardeep Tiwana sentenced him to nine years behind bars with a non-parole period of six years for the ‘heinous’ offence.

The court heard Huici, then 23, was walking home from a 21st birthday party in Geelong’s CBD, 77km south-west of Melbourne, when he broke into the elderly woman’s St Albans Park nursing home about 4.30am on August 15, 2021.

The 90-year-old woman woke to find Huici inside her room before he pinned her to her bed and attempted to kiss and orally rape her.

‘Having gained entry by removing a fly screen and opening a window, you committed a most terrifying and deplorable act of sexual abuse upon an elderly and frail resident who was sleeping in her bed,’ Judge Tiwana said.

The woman managed to activate her duress alarm during the horrifying attack, causing Huici to flee.

Shortly before Huici was due to face trial for rape, he pleaded guilty to attempted rape, aggravated burglary, theft and recklessly causing injury.

During his sentencing on Thursday, Judge Tiwana told the court that sexual frustration was a major factor for Huici’s offence.

‘Although you have pursued a number of short-term liaisons with similarly aged females, you have struggled to maintain intimacy and have never been in a settled romantic relationship,’ Judge Tiwana said.

Referring to a psychological report, he noted: ‘Frustration over a lack of satisfying intimate connection resulted in you acting out this frustration by committing the attempted rape.’

The court also heard Huici was of ‘moderate to high risk of further sexual offending’.

Judge Tiwana noted that despite his admission of guilty, he had shown ‘no real evidence of any contrition’.

‘You have failed to acknowledge your offending in an open and candid manner,’ Judge Tiwana told Huici.

Huici maintained he did not attempt to rape the woman and told a psychologist he ‘pleaded guilty on advice’.

‘Despite expressing some remorse, you immediately qualified that by minimising your offending,’ Judge Tiwana said.

‘I hope you are able to comprehend the impact of your heinous offending.’

The court heard that Huici was raised in a ‘loving family’ environment but turned to drinking and drugs to cope with his long-term anxiety issues.

He also developed a gambling addiction to ‘relieve boredom’. It would sometimes cost him his entire pay packet.

The psychological report found Huici was an 'immature' man for his age who had 'limited intellect' and a 'rudimentary level' of insight into his addictions (pictured, the nursing home where the elderly woman was attacked)

At the time of the attack against the elderly woman, Huici regularly consumed six alcoholic drinks on weekdays and ‘considerably more’ on weekends.

However, he managed to hide his addictions from his family – who Judge Tiwana said were ‘oblivious’ to his ‘deep-rooted issues’.

He noted the attempted rape would have seemed ‘out of the blue’ to his relatives and discounted glowing character references from them as they did not paint a ‘complete picture’ of Huici.nursing

If he had pleaded not guilty, Judge Tiwana told Huici he would have been sentenced to 11 years behind bars.

Huici must register as a sex offender for eight years.
