An IRS whistleblower has called for an independent attorney to be brought in to bring criminal charges against Hunter Biden for ‘willfully’ tax evading.

Joseph Ziegler was known as ‘Mr X’ until he testified publicly before the House Oversight Committee on Wednesday alongside his boss, Gary Shapley.

Ziegler and Shapley were part of the team investigating Biden’s tax affairs, and felt the First Song was not prosecuted to the full extent of the law.

Ziegler told Fox News host Martha MacCallum he was deeply ‘frustrated’ by the subversion of existing rules, and he said there should have been criminal charges.

Biden has been charged civilly, but not criminally, and a plea deal agreed. Ziegler said it was the wrong decision.

‘When you work a criminal case, there’s a thing called willfulness: whether someone intentionally with knowledge either evaded their income taxes or filed a false return,’ Ziegler said. 

‘And that’s what one thing that sets us apart from a civil case. And in this case, we provided a ton of evidence that showed willfulness. 

‘The ultimate reason I went public is that there were a lot of things I thought were improper – not following proper procedures,’ he said.

‘And I thought it was my duty to come forward.

‘When we were invited to come and testify in front of the congressional committee, I didn’t want to leave my supervisor, Gary, there alone. And I thought it was important that for my credibility, that people hear it straight from me.’

Ziegler, who has worked for the IRS since 2010 after a career as an external auditor with Ernst & Young, said he felt it important to speak out despite he and his husband being targeted online for abuse, and despite his self-professed ‘middle of the road Democrat’ leanings.

‘At the end of the day, the reason why I came forward, and the reason I’m putting this information out there: we have to treat taxpayers the same. It’s all about following the evidence and making sure that justice is served,’ he said.

Ziegler said he realized there was an issue when they learnt of a storage unit belonging to Hunter Biden – and that information was passed on to Hunter Biden’s legal team, before they could investigate.

‘Our first really big disagreement would have been related to the storage unit – the search warrant related to the storage unit,’ he said.

‘When I found out that she told defense counsel that we knew about the storage unit, and the records request included that, I just knew that we weren’t – it was kind of a shot to the gut. ‘And we didn’t have a seat at the table.

‘And it was really kind of a defining moment for me, that said that things aren’t following the proper procedure that we would normally follow.’

Ziegler said that he felt there was no chance of a fair charging decision until there were independent people appointed to oversee the case, in Washington DC.

‘If there are other charges that are viewed outside the District of Delaware. David Weiss is going to run into the same problem again and again,’ he said, referring to the U.S. attorney for Delaware, who Ziegler said was blocked from pursuing charges.

Weiss has denied that he was restricted, but Shapley and Ziegler said he was.

‘And that’s why we need to have an independent attorney assigned who has authority, who can go in there, bring the proper charges, so that there can be some faith restored in our justice system,’ Ziegler said.
