Confronting moment cop allegedly assaults a man in a wheelchair over a noise complaint

A police officer faces charges for allegedly hitting and pushing a man in a wheelchair who was being warned over a noise complaint.

CCTV footage of the incident in the northern Victorian town of Shepparton on February 28 appears to show the sergeant striking and shoving Kevin Scott, who is sitting in his wheelchair outside his home.

The officer was attending the premises to warn Mr Scott about the noise coming from his 36th birthday celebration.

Video from Mr Scott’s security camera shows him wheeling towards the officer and the two exchanging words at a close distance.

Mr Scott alleges the officer struck him in the face and that the attack was unprovoked.

‘I couldn’t do nothing,’ he told Seven News.

‘I seen him shut his fist and I wheeled back.

‘Next minute he just hit me straight in the mouth, in the jaw.

‘When I pointed at my camera, that’s when he walked off.’

The video also appears to show the officer pushing a flailing Mr Scott backwards. 

Mr Scott’s sister Kay said her brother was ‘defenceless’.

‘It would be different if my brother spat or tried to throw a punch or put up a fight with them but he never did,’ she said.

‘He was in a wheelchair, defenceless.’

‘We need to be able to feel safe in our community, people need to be aware that this does happen.’

Scott has health issues related to drug and alcohol abuse.

Prior to being charged the officer was transferred to other duties while he was being investigated by Professional Standards Command. 

He will now face two counts of assault and is scheduled to appear at Shepparton Magistrates’ Court on August 11.
