However, Gutierrez-Reed’s defense, led by Jason Bowles, claimed that she was unfairly blamed by the production company, Baldwin, and the prosecutors.

On October 21, 2021, an accident happened during the filming of the movie “Rust” at the Bonanza Creek Ranch in Bonanza City, New Mexico. This sad event led to the death of cinematographer Halyna Hutchins and left director Joel Souza injured.

During a rehearsal, a real bullet was accidentally fired from a prop revolver that actor Alec Baldwin was holding. Baldwin was rehearsing a scene where his character, Harland Rust, an outlaw, was supposed to prepare for a shoot-out in the chapel. In a tragic twist, the gun went off unexpectedly while Baldwin was aiming it, hitting Hutchins, who was trying to film a close-up shot of the gun’s muzzle to create tension in the scene.

Hutchins fell to the floor, and the bullet passed through her, hitting director Joel Souza in the shoulder. Souza was rushed to a hospital in Santa Fe, where doctors successfully removed the bullet, allowing him to recover from his injuries. A projectile removed from Joel Souza’s shoulder was identified as a suspected live round. The investigation involved various authorities, including the state’s First Judicial District Attorney, the New Mexico Occupational Health and Safety Bureau, and the FBI.

In October 2026, the film’s producers hired Jenner & Block’s legal team to conduct an independent inquiry, interviewing the cast and crew. Forensic testing by the FBI in August 2022 showed that the Pietta .45 Long Colt Single Action Army revolver could only be fired intentionally, ruling out mechanical failure.

Gutierrez-Reed chose to plead guilty to negligent use of a deadly weapon, receiving a suspended sentence and six months of probation. However, on January 31, 2023, both Baldwin and Gutierrez-Reed officially faced involuntary manslaughter charges, which could result in up to five years in prison if found guilty.

Initially represented by attorney John Bash, Baldwin’s legal team argued that he was charged under a law enacted after the incident, leading to reduced charges for both Baldwin and Gutierrez-Reed, with a possible maximum sentence of 18 months if convicted.

On March 31, 2023, Gutierrez-Reed pleaded no contest to a misdemeanor charge of negligent use of a deadly weapon, resulting in probation, a fine, and community service. On June 22, 2023, Gutierrez-Reed faced an additional charge of tampering with evidence.

Prosecutors alleged she attempted to obstruct justice by transferring narcotics, specifically hiding a small bag of cocaine after her initial police interview on the night of the shooting. On August 4, 2023, Gutierrez-Reed waived her right to a preliminary hearing.

She pleaded not guilty to both charges on August 9, and her trial was scheduled to run from February 21 through March 6, 2024. On October 17, 2023, six months after felony charges were dropped against Baldwin, prosecutors expressed their intent to convene a grand jury to reconsider criminal charges related to Hutchins’ death.
