The MSU gunman who killed three students in a senseless spree on Monday should have been banned from buying guns after being charged with a felony in 2019 – but a woke prosecutor lowered the offense to a misdemeanor. 

Anthony McRae, 43, was arrested in 2019 for having a loaded gun without a concealed carry permit. 

He was charged with carrying a concealed weapon, a felony which would have prevented him from buying or owning any other weapons if he’d been convicted. 

Instead, the Ingham County Prosecutor’s Office – then run by Carol Siemon – lowered the offense to a misdemeanor.

Anthony McRae, 43, was arrested for having a loaded gun and ammunition without a concealed carry permit in June 2019. It should have stopped him from ever buying weapons again – but the charge was lowered to a misdemeanor by the office of Carole Siemon 

It remains unclear where and when McRae bought the weapon used in Monday’s attack, but he wouldn’t have been able to do so legally had the prosecutors gone through with the felony charge. 

McRae was instead given a plea deal which involved no jailtime.

He was given a two-year probation sentence, from which he was discharged in 2021. 

Police arrested McRae after finding him sitting on the steps of an abandoned building, smoking, at 1.30am on June 7, 2019. 

The officer asked him if he was carrying any weapons.

He told the cop he had a .380 semi-automatic pistol, which was registered to him, but for which he did not have a concealed carry permit. 

The officers found the gun in his pant pocket, but also found a loaded magazine in the pocket of his shirt.

Siemon did not immediately respond to DailyMail.com’s questions about the decision on Tuesday morning. 

She was replaced as the prosecutor for Ingham County last year.  

While in office, Siemon regularly advocated for tighter gun safety laws. 

She frequently posted on her social media pages about recalling rifles and semi-automatic weapons, and also championed LGBTQ causes. 

The new Ingham County prosecutor, John Dewane, shared details of McRae’s plea deal yesterday amid growing anger over the tragedy. 

He said that McRae would never have been sent to jail, because a jury would have focused on his lack of other criminal history, but that the felony charge would have stopped him from owning a weapon in the future.

Michigan AG Dana Nessel said yesterday that part of her investigation would involve how he was able to obtain a gun. 

McRae killed himself on Monday night before police could get to him.
