Convicted fraudster Elizabeth Holmes spent her final days of freedom soaking up the sun with her family – this time without any hope or possibility of a repeat of the last-minute reprieve that allowed her to dodge prison for a month. 

Despite her best efforts to avoid serving time behind bars, Holmes, 39, is now set to begin her 11-year sentence on Tuesday at a federal facility out of state – miles away from the $9million San Diego mansion she shares with partner Billy Evans and their two children. 

With U.S. District Judge Edward Davila setting her revised prison-reporting date to May 30 earlier this month, the disgraced Theranos founder was able to enjoy Memorial Day Weekend one last time with her family.

On Saturday her parents were seen taking care of household errands by stocking up on groceries at a local Whole Foods Market, while Holmes and Evans spent quality family time at Tide Park, a secluded beach two miles north of their home. 

After stationing their car on the cliffside street parking, Evans, 30, and Holmes walked down the long grueling steps leading to shore with their kids in tow. 

They positioned themselves against the backdrop of the cliff away from the other beach goers for privacy.

The couple spent about an hour at the beach, where her son William was seen gleefully running around the sand and splashing in the water. 

At one point, Holmes took three-month-old Invicta for a quick dip into the ocean. 

Dressed in a black hooded beach cover, she waded around the shallow end and dangled her daughter’s feet into the water, while doting dad Evans took several pictures of their final hours together.

It seemed to be a bittersweet moment for the couple whose young children will have to spend much of their childhood without their mother.

Holmes had originally been ordered to begin her prison sentence on April 27, but managed to buy an extra four weeks with her family after scoring a reprieve with a last-minute legal maneuver.  

The mother-of-two temporarily avoided reporting to prison after the Ninth Circuit Court of Appeals agreed to stay her date while she attempts to appeal her conviction. 

The legal tactic deployed by Holmes mirrored a move made in March by her former lover and subordinate, Ramesh ‘Sunny’ Balwani, to avoid a prison reporting date of March 16.

After the Ninth Circuit rejected his appeal three weeks later, Davila set a new reporting date of April 20 for Balwani. 

The same judge set a new prison-reporting date for Holmes on May 16 after a federal appeals court eventually rejected her bid to remain out of prison while she attempts to overturn her January 2022 conviction on four felony counts of fraud and conspiracy.

The punishment also includes a $452million restitution bill that Davila ordered Holmes to pay in a separate ruling issued earlier this month. 

Holmes’s lawyers asked Davila to approve the May 30 prison reporting time to give her two weeks to sort out several issues, including child care for her kids. 

Holmes became pregnant with William shortly before the start of her high-profile trial in September 2021 and  with Invicta shortly after she was convicted of crimes that could have resulted in a prison sentence of up to 20 years.

Her legal team didn’t disclose the location of the prison that she has been assigned to serve her sentence. But they noted she has to prepare to travel outside of California, where she has been living in the San Diego area while free on bail.

Davila has recommended that Holmes be imprisoned in Bryan, Texas – 1,800 miles away from San Diego. 

As previously reported by DailyMail.com, Evans is planning on raising their kids in a newly purchased $3million townhouse that is across the street from the ocean. 

His parents bought the home for $3.25million last year just a month after Holmes had been convicted of four counts of wire fraud and conspiracy. 

The 1700 sq ft townhouse has two bedrooms, three bathrooms and a two-car garage. It is in a gated community.

When Holmes is finally incarcerated, it will bring down the curtain on a dark chapter in Silicon Valley – one that brought her fame and fortune before her scandalous downfall. 

After dropping out of Stanford University in 2003 to found Theranos while still a teenager, Holmes promised to revolutionize healthcare with a technology that would be able to scan for hundreds of diseases and other potential problems with just a few drops of blood. 

The idea helped her raise nearly $1billion from sophisticated investors that included Oracle co-founder Larry Ellison and media mogul Rupert Murdoch, who is owed $125million under the restitution order.

But Theranos’s blood tests never came close to working the way Holmes had boasted, with the support of Balwani, resulting in the company’s collapse and a tale that has been the subject of a book, Bad Blood, an HBO documentary, The Inventor, and a Hulu mini-series, The Dropout, which won Amanda Seyfried an Emmy in the starring role.
