The driver of a ute that smashed into a tree and killed five teenagers faces upgraded charges over the tragedy.

Tyrell Edwards, 19, is charged with five counts of aggravated dangerous driving occasioning death after prosecutors alleged he was speeding at more than 45 kilometres per hour over the limit.

He did not appear at Picton Local Court on Friday morning when the charges were upgraded, reported the ABC.

Edwards had initially faced a charge of dangerous driving occasioning death.

The new charges carry a potential sentence of 14 years in jail if he is found guilty,

Three girls and two boys aged between 14 and 16 died when the P-plate driver is alleged to have lost control of a Nissan Navara ute on East Parade at Buxton, near Picton in Sydney’s south-west on September 6 last year.  

Edwards escaped the smash with non-life threatening injuries.

He remains in the community on bail with strict conditions, including only leaving the family home in the company of his mother for limited reasons including to seek medical attention.

His matter is expected to return to court in April.
