Jade Jagger and her boyfriend will appear before a judge in Ibiza today after they were arrested and held in custody for allegedly assaulting police officers.

Jade, the daughter of Rolling Stones star Mick Jagger, and her new lover Anthony Hinkson were due to be driven in a police van the short distance from Ibiza’s National Police HQ to an island courthouse for the hearing.

Police arrested Jade, 51, and Hinkson, 31, on Wednesday night for allegedly assaulting police officers following a row with staff at the La Oliva restaurant in Ibiza’s Old Town.

The couple were formally questioned by detectives on Thursday following a night in a police cell and are understood to have spent a second night in police custody ahead of their court transfer this morning.

Police have not formally named them or released an official statement about the incident, which saw Hinkson being pinned to the ground and arrested after he allegedly assaulted a police officer at around 9pm on Wednesday.

Jade, 51, who was inside the restaurant is said to have angrily complained to officers about her boyfriend’s arrest.

Jade, who split two years ago from her ex-husband, allegedly accused police of being racist and is said to have pushed one officer before being arrested herself.

Police sources have confirmed a man and a woman were arrested after an alleged assault on officers who responded to calls of an English-speaking male acting aggressively towards restaurant staff who refused to serve him any more drinks and asked him to leave.

Police on the island confirmed early this morning: ‘The detainees arrested on Wednesday night will go to court today.’

Neither jewellery designer Jade or her boyfriend have been charged with any crime under Spanish law, as is normal in Spain where formal charges are only laid shortly before trial.

Police arrested them on suspicion of committing the crime of ‘atentado contra la autoridad’, which covers offences ranging from resisting arrest to assaulting an officer.

People found guilty of such an offence can face prison sentences of one to four years in Spain as well as fines.

Jail sentences of two years or less are normally suspended in Spain for first-time offenders.

It will now be up to an investigating judge to decide what sort of charge the police accusations against Jagger and her lover merit.

It was not immediately clear this morning if the case will be dealt with by way of a speedy trial.

The other most likely option would be for the judge to release the jewellery designer and her partner on bail following a behind-closed-door court hearing, pending an ongoing criminal investigation.

If that occurs the judge could attach conditions to the release that might include a ban on leaving Ibiza and the obligation to sign on at court every month or fortnight.

Video footage emerged yesterday showing how Hinkson was pinned to the ground by police before his arrest. 

Witnesses told MailOnline how Hinkson was behaving ‘erratically’ before his arrest. At one one he is said to have gone into an up-market clothes shop and bought a designer dress for more than 2,000 euros as an impromptu gift for a waitress in a nearby restaurant.

Hinkson is also believed to have berated passers-by before police were called by concerned staff at the La Oliva restaurant where the waitress works.

A witness said: ‘Jade’s boyfriend was behaving very oddly.  I don’t know what made him be like that.

‘At one stage he came outside and went into Annie’s clothes shop on the other side of the road where he bought a dress.

‘He was bothering girls who were in the shop and making comments to a girl who was working there. He was not really making much sense. He was saying, ‘Give me the f***ing dress. He was really rude.

‘Then he took the dress back to the restaurant and tried to give it to the waitress. His behaviour was so erratic that the restaurant manager decided to call police.

‘Seven police officers came and it looked like they tried to calm him down, but he was resisting them and saying really horrible stuff.

‘He did not have his T shirt on and he was bare chested. The police managed to pull him down and they put handcuffs on him, but he was still resisting.

‘I recognised Jade and she looked really upset about what is happening. She was demanding that police officers identify themselves, saying: ‘I don’t want to mess with anyone. Give me your names.’

‘The cops kept telling her to stay out of it, but she was saying, ‘You are just arresting him because he is black’. The police were telling her to stay at home, but she said, ‘No, I am coming with you.’

‘An officer told her, ‘If you keep going, I will arrest you’. Then she was arrested as well.

I didn’t actually see her pushing or anything like that.

‘But I saw an ambulance arrive, and there were loads of police.’

The witness said that Hinkson left the restaurant about half an hour before his arrest and splashed out on a sleeveless gold dress by New York designer LaQuan Smith , priced at 2,102 euros on the shop’s website.

They added: ‘He was buying the dress for a waitress. He was saying, ‘Try something on. I will buy it for you.’ He was bothering everyone and screaming.

‘It was just really weird behaviour. I heard that they had been staying in a house nearby. It also looks like that the waitress got to keep the dress.’

A well-placed source said: ‘Police arrested two people last night, a man and a woman, in Ibiza.

‘Around 9pm there was a police intervention as a result of a call from a restaurant about a man. The man had gone by the time police arrived.

‘People at the restaurant including staff and a manager and a couple of customers told officers he had been aggressive towards them, and they had refused to serve him any more drinks and he left.

‘A man in the street then approached the police patrol cars outside.

‘When officers approached him he began to insult them in English, refusing to identify himself and being very hostile.

‘They tried to calm him down several times. That’s when a woman appeared.

‘Police managed to calm her down and then call an ambulance for the man who was in a bad way.

‘At that moment the woman enters the scene again, squaring up to an officer. She was then also arrested.’

Lisa Salle, the owner of La Oliva restaurant, refused to comment, saying: ‘We are not talking about this.’

But a waitress called Maria who works at nearby La Toretta restaurant, said: ‘This man was super, super drunk. He was super, super crazy.

‘He was drinking whisky in La Oliva. Then he became aggressive and the staff told him to leave. They said: ‘You are disturbing customers. Please go.’

‘Lisa Salle was very polite to him, but he had a bad attitude. He came in to our restaurant and we told him to leave because we were waiting on customers.

‘He went into the shop and the girl in there was very scared of him. Then he went back to La Oliva and the police were called.

‘The police told him, ‘Please calm down. You are disturbing people.’ He was saying things like ‘F**k off’, ‘F**k the police’ and ‘F**k everything’.

‘When the police were arresting him, he was kicking out with his legs. They first restrained him by the arms and then they restrained his legs.

‘They had to carry him some distance to the police car. I am not clear whether Jade Jagger was in the restaurant at the time. I think she may have been staying in a house above a shop.

‘But she came out when he was arrested. She was following the officers down the road as they were taking the man away.

‘They warned her to calm down, but she kept on and she ended up being put against a wall and put in handcuffs.’

Jade who is Sir Mick’s daughter from his marriage to first wife Bianca lasted posted an Instagram picture of herself a week ago when she was at Hotel Nobu in Ibiza.

She accompanied the snap with a message saying: ‘Spring back to ibiza a (sic) with a little glamour @ibizabay #nobu.’

Jade who has had a home on Ibiza for many years was pictured hand-in-hand with Barbadian Hinkson in London last month.

Hinkson was offering bespoke sunset dining experiences at a beach bar in Barbados last year, with Instagram videos showing him manning the BBQ for customers.

It was revealed last month that she had liked a string of images on his account, writing ‘beautiful life on the beach living the dream’ on one picture of an oil drum BBQ.

He has also liked images on Jade’s account, including one of her in a low-cut swimming costume while at sea.

Jade launched her ‘paradisica’ jewellery collection in January last year which she said was ‘inspired by my Caribbean life’.

The businesswoman split from her DJ husband in 2021, nine years after their star-studded Cotswolds wedding. 

She was said to be ‘devastated’ by the breakdown of their relationship, with a source at the time telling the Mail on Sunday: ‘This is all very sad. They thought they would be together for ever but it didn’t work out quite like that.’

Jade revealed in March that she had stopped making jewellery when she wrote on Instagram: ‘Today is the first day I decided to stop working well at jewellery. I think it will bring new light new love and new opportunities thank u to all that supported me. Thanks for the sweet messages… change is good.’
